Proposed order approving the incentive for the reduction of losses in the distribution network for 2016, modifying the 2016 remuneration for several distributors and approving the remuneration of distributors for 2017, 2018 and 2019.

Summary

Royal Decree 1048/2013, of December 27 and Order IET/2660/2015, of December 11, set out the methodologies and parameters required for the calculation of the remuneration of electricity distribution companies until 2019.

In application of these regulations, the remuneration for 2016 was approved by Order IET/980/2016, of June 10, which has been the subject of a high level of litigation, including the contentious-administrative appeal number 265/2018 filed by the State Attorney’s Office, following a declaration of detriment to the public interest, against the aforementioned order. Since the remuneration for 2016 must be used as the basis for the remuneration for 2017, 2018 and 2019, these are pending approval.

Once the Supreme Court has ruled on the aforementioned declaration of nullity and initiated the processing of the order that revises, where appropriate, the remuneration corresponding to 2016, this proposal initiates the processing of the remuneration of the electricity distribution activity for the years 2017, 2018 and 2019.

As a consequence of the foregoing, and without prejudice to the forwarding of the individualized information to each of the distribution companies concerned, a hearing is held on the content of the above mentioned proposed order.
